1. Identification and scope
This website and its booking engine are operated by Premium Host Punta or PHPunta (hereinafter “PHPunta”), acting as manager, marketer, and operator of short-term rentals offered either on its own behalf or on behalf of property owners, administrators, or lawful holders of the listed properties.
Depending on the property and the applicable operational model, PHPunta may act as a commercial intermediary, operational manager, agent, booking manager, or full-service provider related to the guest’s stay.
Use of the website, submission of inquiries, availability requests, and/or booking confirmation implies acceptance of these General Terms, together with the Privacy Policy, Cookie Policy, and any specific conditions applicable to each property.
2. Nature of published information
Descriptions, photographs, surface areas, equipment, distances, views, services, amenities, and other property-related information are provided for informational purposes and aim to reasonably reflect the property’s characteristics at the time of publication.
However, non-material variations may occur due to updates, maintenance, furniture changes, owner decisions, renovations, weather conditions, third-party service availability, or other circumstances beyond PHPunta’s direct control.
3. Booking process
A reservation shall only be deemed confirmed once the following conditions have been met, as applicable:
a. explicit confirmation of availability;
b. proper identification of the main guest;
c. acceptance of the applicable conditions;
d. full or partial payment as required; and
e. issuance of a confirmation by PHPunta or the authorized booking system.
PHPunta reserves the right to reject booking requests in cases of inconsistent data, operational limitations, prior non-compliance by the guest, specific property restrictions, or reasonable concerns related to safety, coexistence, or regulatory compliance.
4. Prices, currency, and taxes
Published prices may be expressed in U.S. dollars, Uruguayan pesos, or other currencies indicated on the website. Unless otherwise stated, prices refer to the accommodation cost and may exclude additional charges such as processing fees, cleaning, security deposits, taxes, extraordinary consumption, or other duly disclosed items prior to final confirmation.
PHPunta will make reasonable efforts to keep pricing information updated; however, until the booking is confirmed, prices and conditions may be modified without prior notice.
5. Payment methods
Payments may be made through electronic gateways, credit/debit cards, bank transfers, or other payment methods authorized by PHPunta.
The guest warrants that the payment method used belongs to them or has been duly authorized. All transactions are subject to security validations, fund confirmation, anti-fraud checks, and any additional verification required by PHPunta, the payment gateway, or the payment issuer.
6. Security deposit and additional authorizations
For certain properties or bookings, PHPunta may require a security deposit, pre-authorization, temporary hold, documentary guarantee, or equivalent mechanism to cover damages, missing items, extraordinary consumption, breaches, fines, or additional costs attributable to the guest or accompanying persons.
The conditions of such guarantee — amount, modality, release timeframe, and retention scenarios — will be communicated before or during the booking process.
7. Check-in, check-out, and identification
Check-in and check-out times will be those communicated for each reservation or property and must be respected for operational coordination.
The main guest must provide accurate information and, when requested, proof of identity, list of occupants, contact details, and other reasonably necessary information for managing the stay.
PHPunta may deny access or cancel the reservation if:
a. the guest’s identity does not match the reservation;
b. undeclared occupants are detected;
c. maximum occupancy is exceeded;
d. there are reasonable indications of improper use of the property; or
e. required documentation or payments are not fulfilled.
8. Permitted use of the property
Guests must use the property and its facilities diligently, responsibly, and in accordance with its intended purpose, respecting at all times:
a. maximum occupancy limits;
b. coexistence and behavioral rules;
c. building, neighborhood, or complex regulations;
d. safety guidelines; and
e. operational instructions provided by PHPunta.
Unless expressly authorized in writing, the following are prohibited:

parties, events, or mass gatherings;

subletting or transferring occupancy;

accommodating undeclared persons;

illegal, disruptive, dangerous, or immoral activities;

improper handling of installations;

bringing pets when not permitted;

smoking in prohibited areas.
Non-compliance may result in immediate termination of the stay, retention of payments, loss of the security deposit, and claims for damages.
9. Property condition, damages, and observations
Guests must report any relevant observations regarding the property’s condition within a reasonable time after check-in. In the absence of timely notice, the property shall be presumed to have been received in adequate condition, unless proven otherwise.
Guests shall be liable for damages, missing items, breakages, excessive dirtiness, abusive use, loss of keys or access devices, fines, or additional costs caused by themselves or associated persons.
10. Services, equipment, and contingencies
PHPunta will make reasonable efforts to deliver the property in proper condition. However, it does not guarantee uninterrupted continuity of services beyond its direct control, including electricity, water, internet, cable or streaming, gas, elevators, building amenities, or third-party public or private services.
PHPunta shall also not be responsible for issues arising from weather, nearby construction, external noise, general outages, force majeure, authority actions, or events beyond reasonable control.
11. Guest cancellations
Unless specific conditions apply, the general policy is:
Stricter conditions may apply for high season, special dates, promotional bookings, long stays, or specific properties.
Early departures, no-shows, voluntary reductions, or cancellations after check-in shall not entitle guests to refunds unless expressly agreed by PHPunta.
12. Exceptional modifications or cancellations
If due to extraordinary circumstances, force majeure, operational impossibility, incident, or unforeseen unavailability the property cannot be delivered as agreed, PHPunta may:
a. offer an alternative property of reasonably equivalent or superior characteristics;
b. reschedule the booking; or
c. refund amounts legally or contractually due.
Unless gross negligence or willful misconduct exists, such situations shall not generate liability for loss of profits, indirect damages, relocation costs, or additional compensation.
13. Limitation of liability
To the fullest extent permitted by law, PHPunta shall not be liable for lost, forgotten, or stolen items; accidents resulting from imprudent use; damages caused by unrelated third parties; service interruptions outside its control; or subjective expectations not expressly guaranteed.
14. Communications
The guest agrees that communications related to inquiries, bookings, stay management, incidents, payments, modifications, and post-stay matters may be conducted via email, WhatsApp, phone, SMS, or other reasonable channels.
15. Data protection
Personal data processing shall be governed by the Privacy Policy available on this website and applicable regulations.
16. Applicable law and jurisdiction
These General Terms shall be governed by the laws of the Oriental Republic of Uruguay. Any dispute shall be submitted to the competent courts in accordance with applicable regulations.
